Wumpix Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) is part of the Wumpix Terms of Service available at https://wumpix.com/legal/terms (the “Agreement”). Capitalized terms not defined in this AUP have the meanings given in the Agreement.
This AUP applies to every Customer and User of the Wumpix / Vividor Services. By using the Services, you agree to this AUP.
Wumpix may suspend or terminate access, remove content, throttle features, or take other enforcement actions for violations of this AUP, as further described in the Agreement.
1. Purpose
The Services are business tools for lawful lead generation, outreach, dialogue management, campaign operations, analytics, and related workflows. You must use the Services only for lawful purposes and in accordance with the Agreement, the Documentation, your Scope of Use, and the rules of any messaging, telecom, or advertising platform you connect.
You are responsible for:
- all Customer Data and content you submit, store, or transmit through the Services;
- all messaging, calling, posting, scraping, enrichment, and targeting you perform with the Services;
- obtaining and documenting any notices, consents, opt-ins, or other lawful bases required for your processing and outreach;
- the acts of your Users and anyone using your Account credentials;
- configuring security settings, integrations, and AI Features appropriately.
2. Prohibited content
You may not upload, store, transmit, distribute, or process content that:
(a) violates any applicable Law; (b) infringes or misappropriates any third party’s intellectual property, privacy, publicity, or other rights; (c) is deceptive, fraudulent, or impersonates any person or entity (including Wumpix); (d) promotes, facilitates, or instructs others in criminal activity; (e) contains child sexual exploitation or abuse material, or otherwise exploits or harms minors; (f) promotes terrorism, violent extremism, or human trafficking; (g) constitutes harassment, threats, hate speech directed at a protected class in a manner that violates Law, or doxxing; (h) contains malware, ransomware, spyware, phishing kits, exploit code, or password-stealing material; (i) is defamatory where prohibited by Law; or (j) is otherwise unlawful in the jurisdictions relevant to your campaigns or recipients.
3. Prohibited messaging and lead-generation practices
Because the Services are commonly used for outreach, the following are strictly prohibited:
(a) sending spam, unsolicited bulk messages, or commercial electronic communications without a valid lawful basis and without required identification and opt-out mechanisms; (b) failing to honor unsubscribe, opt-out, “stop,” or equivalent requests promptly; (c) harvesting, scraping, buying, renting, or using contact lists unlawfully, or using lists for which you lack the required consent or other lawful basis; (d) spoofing sender identity, forging headers, falsifying originating domains, or misrepresenting your affiliation with Wumpix, a messaging platform, or any third party; (e) using the Services to evade spam filters, platform rate limits, reputation systems, or anti-abuse mechanisms of email providers, messengers, carriers, or social platforms; (f) running campaigns that generate excessive bounces, spam complaints, blocklist listings, or abuse reports; (g) contacting people who have clearly refused contact or are on your suppression / do-not-contact lists; (h) using deceptive subject lines, preview text, landing pages, or call-to-action content to obtain engagement or personal data; (i) using the Services for pyramid schemes, unlawful multi-level marketing, or advance-fee fraud; (j) violating the terms, policies, or technical requirements of any connected Third-Party Product (including Telegram, email service providers, CRM vendors, ad networks, and app stores).
Customer must maintain records sufficient to demonstrate lawful basis and opt-out handling for outreach conducted through the Services.
4. Security and technical abuse
You may not:
(a) probe, scan, penetrate, or test the vulnerability of Wumpix systems, networks, or Accounts without prior written authorization from Wumpix security@wumpix.com; (b) breach or circumvent authentication, authorization, encryption, rate limits, quotas, or other security or usage controls; (c) interfere with or disrupt the Services, servers, networks, or other customers’ use (including denial-of-service activity); (d) access data or Accounts that are not yours, or attempt to do so; (e) mine cryptocurrency or run workloads unrelated to ordinary use of the Services; (f) use automated means to create Accounts or scrape the Services except through documented public APIs within published rate limits and solely for your licensed use; (g) introduce or transmit viruses or other harmful code.
5. Account and platform misuse
You may not:
(a) share User seats or credentials in a manner that defeats metering, licensing, or security controls; (b) resell, white-label, timeshare, or provide the Services to third parties as a competing hosted offering unless your Order expressly authorizes it; (c) reverse engineer or copy non-public features for the purpose of building a competing product; (d) use Free or Beta Products to circumvent paid Scope of Use limits; (e) misrepresent your identity, company, or authority when registering or administering an Account; (f) use the Services if you are legally prohibited from receiving them under the laws of your jurisdiction.
6. Sensitive and regulated data
Unless Wumpix has expressly agreed in a signed Order or addendum that specifically authorizes the relevant processing (and any additional terms apply), you must not use the Services to collect, store, transmit, or otherwise process:
(a) protected health information governed by HIPAA or analogous health privacy regimes; (b) payment card primary account numbers, full track data, or CVV/CVC codes (use approved payment processors instead); (c) government-issued identity numbers where Law restricts SaaS processing of that data in this context; (d) personal data of children under 16 (or under the higher age required by local Law); (e) special categories of Personal Data under GDPR Article 9 (e.g., health, biometric identifiers used for unique identification, sexual orientation, political opinions, religious beliefs), except to the limited extent incidentally included in ordinary business communications without being solicited or systematically processed; (f) data subject to heightened secrecy regimes (certain classified, export-controlled, or sector-specific sealed data) for which the Services are not certified.
Customer remains solely responsible for classifying its data and for not submitting prohibited data.
7. AI Feature rules
If you enable AI Features, you must not:
(a) use AI Features to generate content that violates this AUP or Law; (b) attempt to extract model weights, systematically exfiltrate proprietary system prompts, or bypass safety controls; (c) submit secrets, credentials, or regulated data that you are not authorized to process with Subprocessors; (d) represent AI-generated content as human-generated where disclosure is required by Law or platform rules; (e) rely on AI outputs for legal, medical, financial, or other high-risk decisions without qualified human review where Law or professional standards require it.
Customer is responsible for reviewing AI outputs before publishing or sending them to third parties.
8. Fair use and resource consumption
Even within the purchased Scope of Use, Wumpix may take action if usage patterns: (a) threaten platform stability; (b) are indicative of compromised Accounts; (c) create disproportionate load relative to the Customer’s plan without a reasonable business purpose; or (d) correlate with abuse signals (spam complaints, botnet behavior, credential stuffing). Wumpix will make commercially reasonable efforts to limit suspension to the affected portion of the Services and to notify Customer when practicable.
9. Customer obligations toward end contacts
Customer must:
- provide accurate sender / controller identity in outreach where required;
- include a working unsubscribe or equivalent opt-out mechanism where required;
- process opt-outs without undue delay and suppress future sends;
- honor applicable quiet hours, frequency caps, and channel-specific rules;
- ensure landing pages and data-capture forms linked from Wumpix campaigns are accurate and lawful;
- not use Wumpix to threaten, coerce, or harass recipients.
10. Monitoring and investigation
Wumpix has no general obligation to monitor Customer Data. Wumpix may investigate suspected AUP violations using Account metadata, abuse reports, Subprocessor alerts, network telemetry, and Customer-provided information. Wumpix may review and delete Customer Data that Wumpix determines in good faith violates this AUP or the Agreement, without a duty to pre-screen content.
11. Enforcement
If Wumpix determines that a violation has occurred or is likely, Wumpix may, depending on severity and recurrence:
(a) issue a warning; (b) require remediation within a stated period; (c) throttle or disable sending, enrichment, AI, API, or other features; (d) remove or quarantine offending Customer Data; (e) suspend Users or the Account; (f) terminate the Agreement for cause; (g) report activity to law enforcement, regulators, or affected platforms; (h) charge reasonable reactivation fees after suspension for cause where access is restored.
Where practicable and lawful, Wumpix will notify Customer before suspension, except in urgent cases involving security, Law, ongoing spam floods, or imminent harm.

Include as much detail as possible: timestamps, message samples or headers, workspace or Account identifiers, IP addresses, and URLs.
13. Changes
Wumpix may update this AUP by posting a revised version at https://wumpix.com/legal/aup. Material changes follow the notice and effectiveness rules in Section 18 of the Terms of Service.
14. Relationship to other documents
This AUP supplements the Terms of Service. Violations of this AUP are material breaches of the Agreement. The Privacy Policy and DPA govern Personal Data handling; this AUP governs permitted operational use of the platform.
